Terms and Conditions

1. PAYMENT
Inventive Studios offers its customers excellent value for money. However, in order to keep our costs low, we regret we are not able to extend credit. All hosting and domain name services must be paid for at the time of order. For web design services, we require a deposit equivalent to 50% of the total cost of the work ordered. The balance is due upon completion of the website to the specifications given on the customer requirement form. Payment should be made by cash or a cheque made payable to GE Brown. We regret that we cannot accept payment via credit or debit cards. If payment is outstanding for longer than 10 days beyond the completion of the work, we reserve the right to take down the web site until such time as payment has been received in full. Deposits are not refundable once work has commenced.

2. CONTENT
You are responsible for the legality of all content hosted with us. You are also responsible for ensuring that the content is accurate. The following are examples of content deemed inappropriate: racist material, pornographic or otherwise offensive material, copyright material which you do not have rights to distribute, cracks/hacks. This is not an exhaustive list and we reserve the right to remove any content that we consider to be illegal, offensive or contrary to copyright laws or where we have received a complaint from an official body. Persistent offenders will have their accounts closed, refunds will not be given.

3. HOSTING SERVER USAGE
Our hosting services are designed specifically for use by smaller businesses. Only one web site may be hosted on each hosting account. You may not resell or re-allocate all or any part of this space to another party.

4. AVAILABILITY & EXCESS USAGE POLICY
Your web site will be hosted on a shared server. We and our suppliers will attempt to ensure your web site is available most of the time, however no service level guarantees are given and occasional downtime should be expected. Your web site will make demands on processor and bandwidth resources. While we do not limit use of these resources, if your website traffic should build to such an extent that it is reducing the performance of other web sites on the same server we reserve the right to ask you to move it to a more appropriate service. If such an event occurred we would assist you in sourcing a suitable hosting platform, based on your traffic profile and your hosting fee would be refunded on apro-rata basis.

5. SERVICE MODIFICATIONS
In order to offer our clients continued value for money, we may occasionally have to review our suppliers. In the event that we change our suppliers you may experience down-time and may have to re-load your server to a new server. In the event that the functionality offered by the new service wasless than that currently offered. You may have a pro-ratarefund of your remaining hosting rental.

6. DATA BACK-UP
The data on your server is backed up each night. However you should keep your own local copy as we cannot be responsible for your data, only the provision of the hosting service. Customers using the web design service will be issued with a copy of their web site on disk once payment has been received.

7. DOMAIN NAMES
1a.) Inventive Studios will consider all submitted requests for domain name registration and accept or reject them inaccordance with guidelines set by the relevant domain registration body (Internic for .com or Nominet UK for .co.uk). 1.b) Upon acceptance of registration requests submit names for registration and make full registration upon receipt of payment. 2.) The domain name registration period runs for two years from the date of registration. After this time period has lapsed registration renewal may be made for periods of two or more years indefinitely, upon receipt of payment of renewal fees .3.) Once a registration request has been completed no refunds will be made by Inventive Studios. 4.) Inventive Studios process domain registration requests on a first come, first served basis. Until the registrant receives confirmation of registration from Inventive Studios there is no guarantee that the domain name requested will be registered. 5.) Inventive Studios may cancel or halt domain name registrations under certain circumstances, including; where completing the registration puts Inventive Studios in conflict with guidelines set by the registration body; where Inventive Studios believe that there may be conflicts of rights to a particular name.6.) Inventive Studios does not accept any responsibility for the use of registered domain names especially where there may be conflict over rights to ownership.7.) Inventive Studios will do all they can to ensure that the registrant's details are submitted correctly during registration. Inventive Studios will not be liable under any circumstances for loss of profit suffered by the registrant. 8.) The registrant agrees that all details submitted in respect of a domain name registration are true and correct and any alterations made after the initial registration will be also. 9.) The registrant makes certain to Inventive Studios that the registration of a domain name and the way in which it is used (directly or indirectly) does not infringe the legal rights ofany third party. 10.) Data submitted by the registrant pertaining to the registration of a domain name may be available to other organisations and members of the public. 11.) The domain registrars reserve the right to vary terms and rates for domain renewals/transfers and as such Inventive Studios reserve the right to alter our terms in line with their terms.

8. INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold Inventive Studios harmless from any and all demands, liabilities,losses, costs and claims, including reasonable legal fees asserted against Inventive Studios, its agents, its customers, officersand employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Inventive Studios against liabilities arising out of; (1) any injuryto person or property caused by any products sold or otherwise distributed in connection with Inventive Studios' server; (2) any material supplied by customer infringing or allegedly infringingon the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Inventive Studios' server.

9. CANCELLATION
Inventive Studios reserves the right to cease hosting services, giving customers 30 days notice. Upon such termination any remaining rental will be refunded on a pro-rata basis. No refunds will be given in the event of our terminating service to a customer due to a breach of these terms and conditions. Web design, domain registration and other set-upcosts incurred will not be refunded.

10. JURISDICTION
The law of England and Wales governs this Agreement, and the Client submits to the exclusive jurisdiction of the Courts of England and Wales.
